Breakfast Meeting: Residency for Minnesota Tax Purposes

Residency is a hot issue for high tax jurisdictions, and impacts your donors whether they are considered non, part-year or full-year residents for tax purposes. The presentation will touch on the impact of charitable giving and loans of artwork in residency determinations, the recent Minnesota Department of Revenue Residency Report issued March 13, 2015, controversy created by recent MN Supreme Court residency decisions, legislation proposed by a coalition of professional associations in Minnesota, and the Policy, Administrative and Procedural issues that follow for our donors and clients.

About the Presenters:

Michael Sampson, Partner, Maslon

Michael's legal practice focuses on high-end estate and tax planning, estate and trust administration, charitable planning, and business succession planning. Michael helps his clients focus on what it is they really want to accomplish with their wealth. After assisting his clients in identifying their specific wealth planning goals, Michael works with them and their other professional advisors to develop and implement wealth transfer strategies that are consistent not only with their goals, but also with their cash flow needs and tolerance for risk.

Michael is a frequent speaker at continuing legal education seminars and enjoys teaching as an adjunct professor at Hamline University School of Law in St. Paul (Wills & Trusts, Estate Planning & Tax, and Drafting Wills & Trust Agreements). He is also very active in the Minnesota State Bar Association, currently serving as a member of the Probate and Trust Law Section Council and as co-chair of the Section's Legislation Committee. Michael has also served for the last three years on a special sub-committee that is reviewing Minnesota's trust law.

Michael currently serves as chairman of the Board of Directors of Guild Incorporated, a St. Paul-based non-profit that works with individuals with severe mental illness. Before joining the board of Guild Incorporated, Michael was a founding member and past chair of the Board of Directors of the Twin Cities German Immersion School (TCGIS).

Scott Nelson, Attorney at Law, CPA, Hellmuth & Johnson

Scott Nelson, attorney and CPA, assists individuals and closely-held businesses with tax, business and all aspects of estate planning. He counsels business owners on business succession and coordinated estate planning, and advises families on transfer of assets and legacy planning during lifetime or upon death. His practice includes advice to trust and estate fiduciaries (trustees and executors), beneficiaries and charitable organizations. Scott is a Fellow of The American College of Trust and Estate Counsel, a member of the MSBA Probate & Trust Law Council, past chair of its legislation committee, serves as a planned giving advisor, expert witness in trust and estate matters, has served as a board member or officer for various professional and non-profit organizations, and is a frequent faculty member and guest speaker on estate, trust and tax planning issues. He continues to be active with advocacy initiatives for the MSBA and MNCPA.

Josh Hanson is a Marketing Consultant for the Stelter Company, a leading source for strategic marketing for the nonprofit community. Josh currently serves more than 300 organizations in the Midwest. Josh’s responsibilities including planning, facilitating and executing strategic marketing programs for Stelter Company clients in the Midwest region. His primary concentration is to understand each nonprofits history, mission and fundraising goals in order to develop strategic marketing solutions to best support the short and long term goals of the organization.

Josh is a graduate of the University of Iowa with a B.B.A. in finance. When not on the road seeing clients, Josh enjoys spending time with his family, coaching youth sports, golfing, and skiing. He and his wife Michelle are the proud parents of three boys.
